(1) According to section 10, in case of making a memorandum of understanding or preliminary project agreement, within the time period mentioned in the memorandum of understanding or preliminary project agreement, and in case of not having a memorandum of understanding or preliminary project agreement, the proponent shall submit the following details related to the implementation of the project to the Government of Nepal within the time period specified by the Government of Nepal, which shall not exceed six months based on the nature of the project. :-
(a) Description of the project,
(b) Detailed feasibility study of the project,
(c) Detailed engineering design of the project,
(d) Project Environmental Study Report,
(e) If the project is to be implemented in a phased manner, the details thereof,
(f) Method of project implementation,
(g) Forecast of expenditure and income of the project implementation period,
(h) Institutional arrangements for project implementation,
(i) Proposed fees to be charged from the consumer while executing the project,
(j) If any agreement has been entered into with other persons regarding the implementation of the project, the details thereof,
(k) Proposed royalty to be paid to the Government of Nepal while running the project,
(l) Details regarding potential sources of investment,
(d) Provisions relating to insurance of the project,
(d) Area in which the project will be implemented,
(n) Arrangements regarding the financial procedure to be adopted by the proponent in connection with the implementation of the project,
(p) Other details as specified.
(2) If the proposer is unable to submit the details as per that sub-section within the period as per sub-section (1) and submits an application to the Government of Nepal for an extension of the time period, the Government of Nepal may extend the time period by a maximum of three months.
(3) In the case of a particular project, if the proponent is unable to submit the details as per Clauses (b) and (c) of Sub-section (1) within the period as per sub-section (1) or (2) while examining the application submitted to the Government of Nepal, the Government of Nepal Such proposer may be exempted to submit the details after the agreement is reached.
